Lawsuit refiled to stop renewable energy fees

The Goldwater Institute has refiled its lawsuit against the Arizona Corporation Commission over its rules to raise money to implement renewable energy.

Attorneys filed the suit on behalf of three Arizona Public Service customers over charges totaling $1.32 a month that are part of the state’s Renewable Energy Standard and Tariff Rules. The charges were instituted to allow utilities to collect money to tap more renewable sources.

The lawsuit claims the ACC doesn’t have the authority to set such a fee under the state constitution.

A previous lawsuit on the matter was rejected by the Arizona Court of Appeals.

In that suit, the ACC argued its rate-setting authority granted by the state constitution allows it to institute the fee.

" We all need to get our heads out of the sand or our necks out of the clouds...it's not just about alternative energy and green jobs. Yes, we do need that in our present time. The furture holds a time for many of the people to be taxed on their carbon use, not be able to read their power bills because they have allowed others to place tariff taxes on the fuel use or better yet transmission line for your renewable energy. Take note when a goverment offical has his job for 37years...retires with bennies and pay...nobody has to back him with a bailout yet...until we can't pay or afford penilities and interest or run to the hills to avoid taxes. "

" Sherry you are so right! Our dependence on foreign oil costs us an order of magnitude more than the $1.32 per month mentioned in the article. We are now out of time. We MUST get off fossil fuels immediately - our very existance as a society depends on it - literally. "

" We must not as a nation forget the role the high cost of our dependence on foreign fuel played in the demise of our automakers. The exorbitant cost of gas the past year has done serious damage to our economy and society. We need to take lessons from our mistakes.WE also need to get out from under the grip our dependence on fore gin oil has on us. Why not take some of these billions and invest in America becoming energy independent. Driving an electric car would cost the equivalent of 60 cents a gallon. The electricity could be generated by solar or wind power. Green technology would create millions of badly needed new jobs. What America needs is a green revolution. It is time for us to move forward with alternative energy. I just read Jeff Wilson's new book The Manhattan Project of 2009. I highly recommend this book to anyone who is concerned about the downward spiral of our economy and it's effect on our society and would like to see our country become energy independent! "
